The Regulations of Arrangement and Supervision of Private Insurance (1) establish that the Directorate General for Insurance and Pensions Funds may agree on the publicity that it considers necessary for public information in the case of organisations that carry out insurance operations without having obtained the mandatory administrative authorisation.
Also, with the aim of improving the protection of insurance services customers, the need is proposed of giving publicity of the activity performed by organisations with registered address in other member states of the European Economic Space, which, due to their name or the confusing definition of the operations they carry out, may lead to error by persons contracting with them, giving an appearance of insurance companies, insurance brokers or insurance brokerage companies when they are organisations that do not perform said activities.
Considering the above, and taking into account the information received from the supervision bodies of the respective States, the Directorate General for Insurance and Pensions Funds has decided to publish the following:
The companies listed as follows are not authorised as insurance companies, nor may they exercise said activity in Spain under the system of the free provision of services from another member state of the European Economic Space, or under the system of the right of establishment through a branch in Spain. Contracts entered into with these companies under the name of insurance contracts or other forms that lead to the understanding that they are carrying out insurance operations are null and void in law in accordance with Article 5 of the Private Insurance Arrangement and Supervision Act 30/1995, of 8 November 1995.

It should be stated that, in the case of insurance companies that operate under the system of the right of establishment or of the free provision of services, the authorisation of these companies, in accordance with the provisions of Article 78 of the aforementioned Private Insurance Arrangement and Supervision Act, correspond to the state of origin in the European Economic Space, which is competent for the financial supervision of these companies, and must be recorded in the administrative registry, which can also be consulted on this site in the Public Records section.
Las personas y sociedades enumeradas a continuación, no están inscritas ni autorizadas por la Dirección General de Seguros y Fondos de Pensiones para realizar la actividad de mediación de seguros y correduría de reaseguro, ni pueden ejercer dicha actividad en España en régimen de libre prestación de servicios desde otro Estado miembro del Espacio Económico europeo, ni en régimen de derecho de establecimiento a través de una sucursal en España.(3)
